Why this Code matters

This Code is supported by NHS Scotland’s governance systems, which ensure safe, effective, and person-centred care through:

  • Clinical governance – promoting high standards of care and continuous improvement
  • Staff governance – fostering fair, inclusive, and supportive working environments
  • Information governance – safeguarding confidentiality and data integrity


It aligns with legal duties under the NHS (Scotland) Act 1978, including:

  • Section 12I – requiring NHS Boards and agencies to have systems in place to manage and support staff effectively
  • Section 12H – requiring monitoring and improvement of healthcare service quality

and

  • Health and Care (Staffing) (Scotland) Act 2019 – Section 12II – placing a duty to ensure appropriate staffing, including training and development of staff.
